Dear Mr. President:

As you know, section 641 of Public Law 108-447, the Consolidated Appropriations Act, 2005, provides the annual reporting requirements for the Buy American Act and requires each Federal agency to submit a report to Congress on the amount of acquisitions made by the agency from entities that manufacture the articles, materials, or supplies outside of the United States in that fiscal year.

In compliance with the requirement stated above, Secretary Elaine L. Chao has asked me to respond on behalf of the Department of Labor. As such the Department provides the following information for FY 2005:

  1. Provide the dollar value of any articles, materials, or supplies purchased that were manufactured outside of the United States:

    Response: The Department of Labor made $30,430 in purchases of articles, materials, or supplies manufactured outside of the United States within the meaning of the Buy American Act.

  2. Provide an itemized list of all waivers granted with respect to such articles, materials, or supplies under the Buy American Act (41 U.S.C. 10a et seq.);

    Response: All $30,430 of purchases in response to Question #1 were made pursuant to section 517 of Public Law 108-447, which exempts commercial information technology from restrictions of the Buy American Act.

  3. Provide a summary of the total procurement funds spent on goods manufactured in the United States versus funds spent on goods manufactured outside of the United States.

    Response: The Department of Labor spent $45,557,122 on goods manufactured in the United States. As stated in Question #1, the Department spent $30,430 on goods manufactured outside of the United States.
