Division of Energy Employees Occupational Illness Compensation (DEEOIC)

On January 23, 2023, DEEOIC published EEOICPA Circular No. 23-01, DEEOIC NDC Exclusion List. This circular provides notice that the Division of Energy Employees Occupational Illness Compensation (DEEOIC) has instituted a NDC exclusion list for certain medications, medical supplies, and durable medical equipment (DME) under the Energy Employees Occupational Illness Compensation Program Act (EEOICPA).

DEEOIC provides to an individual eligible to receive medical benefits under the DEEOIC payment for the services, appliances, and supplies prescribed or recommended by a qualified physician for that illness, which are considered likely to cure, give relief, or reduce the degree or the period of that illness. The Office of Workers’ Compensation Programs’ (OWCP) Division of Administrative Operations (DAO) conducts an ongoing examination of medications, medical supplies, and DME to determine their efficacy and safety in treating diagnosed medical conditions. During the review, DAO and DEEOIC may certify the exclusion of products. When this occurs, DEEOIC will publish on its website a listing of excluded products for which the DEEOIC will not pay and set the corresponding NDC to deny. You can find the list below.

DEEOIC will continuously and regularly review and evaluate NDCs in accordance with the policy. As DEEOIC adds new NDCs, we will update the list. We expect providers to review this list prior to dispensing products to determine if the NDC will be covered for payment.

The DEEOIC will not authorize or reimburse pharmacies, medical providers, or claimants for items on the NDC exclusion list, unless DEEOIC grants a case specific exception.
