Overview

The Migrant and Seasonal Agricultural Worker Protection Act (MSPA) protects migrant and seasonal agricultural workers by establishing employment standards related to wages, housing, transportation, disclosures, and recordkeeping.  MSPA also requires farm labor contractors to register with the U.S. Department of Labor (DOL).

Before performing any farm labor contracting activity, a farm labor contractor (FLC) must register with DOL’s Wage and Hour Division (WHD) and obtain a Certificate of Registration.  A FLC must be specifically authorized to provide housing or transportation to migrant or seasonal agricultural workers prior to providing the housing or transportation.  Persons employed by farm labor contractors to perform farm labor contracting activities, known as farm labor contractor employees (FLCE), must also register with WHD.

This registration process serves a critical role in ensuring the migrant and seasonal agricultural worker protections under MSPA.  Registration ensures that FLCs and FLCEs can be located when necessary, and that any housing and/or transportation that the FLC intends to provide meets basic standards at the time of registration. FLCs and FLCEs who perform farm labor contractor activities must carry proof of registration and show it to workers, agricultural employers, agricultural associations, and any other person with whom they deal as contractors.

Application Filing Announcements

  • As of 10/18/2021, WHD has published a new Form WH-530 application for FLC Certificate of Registration, Form WH-535 application for FLCE Certificate of Registration, and Form WH-540 application to amend a Certificate of Registration.  WHD will continue to accept the old WH-530 until March 31, 2022. This list contains the name and physical address of all current certificate holders, as well as the expiration date and the certificate number generated by the Wage and Hour Division.  The list also indicates if the contractor has been authorized to house workers, to use vehicles to transport workers, or to drive such vehicles.
